04/12/2018 12:00 AMThe family of Ethan Song, the 15-year-old Guilford High school freshman who was fatally shot at a home in town on Jan. 31, has filed a lawsuit in New Haven Superior Court against the owner of the home where the incident occurred.
Police responded to a call about a shooting on Jan. 31 to a home on Seaside Avenue. Upon arrival, police found two teenage boys inside the home. Song was transported to Yale New Haven Hospital where he was later pronounced dead.
The home at which the teens where found on Seaside Avenue is currently rented by private investigator Daniel Markle.
The lawsuit filed by Song’s parents, Mike and Kristin Song, claims that Markle “unsafely stored and/or kept a loaded gun on the premises when he knew or should have known that a minor was likely to gain access to the gun without the permission of his parent.”
The lawsuit lists six accounts including recklessness, liability, and negligence. The Song family is seeking monetary and punitive damages.
Markle is the son of the late New Haven State’s Attorney Arnold Markle, who served from 1968 to 1987 and prosecuted numerous high-profile cases including the trials of several members of the Black Panthers in the 1970s.
Guilford Police reported back in February that the case or any possible charges would be tried under Waterbury State’s Attorney Maureen Platt. Guilford normally falls under the New Haven Judicial District, which includes the towns of Branford, North Branford, Guilford, Madison, East Haven, and North Haven, among others.
