09/14/2017 03:47 PMOn Friday, Sept. 8, an attorney representing Pacileo's Apizza & Pasta Restaurant and Albert Pacileo III filed suit against the Town of North Branford, four town leaders, Doody's Totoket Inn and a Doody family member. The suit's multi-page complaints against the seven defendants range from ethics violations to allegations of actions or inactions impacting the financial success of Pacileo's North Branford restaurant, which opened in January, 2016 at 285 Foxon Road.
The suit specifically names as defendants the Town of North Branford, Mayor Michael J. Doody, Police Commissioner David Palumbo, Superintendent of Schools Scott Schoonmaker, Public Works Director Fran Merola, Doody's Totoket Inn, Inc. (465 Foxon Road) and Joann Doody. On September 13, town attorney Pasquale "Pat" Young (Berdon Young & Margolis PC, New Haven) filed an appearance response on behalf of all defendants.
The three-count suit claims involvement of all defendants in "tortious interference with business relations" and "civil conspiracy" to the fiscal detriment of Pacileo's Apizza. In addition, the suit contends "violations of the Connecticut Unfair Trade Practices Act" against Doody's Totoket Inn, Joanne Doody and Michael Doody.
The suit was brought by attorney Michael A. Zamat (Peterson Zamat LLC, Fairfield). Zamat has also filed a pre-judgment remedy application seeking to set aside the sum of $2 million in the event a judgement is entered.
A hearing on the pre-judgement application is set for October 16 at New Haven Superior Court.
