Farm River Rock Quarry Adds $30 Million Suit Against East Haven


The Farm River Rock Quarry, located on Barberry Road in East Haven, has filed a $30 million lawsuit against the Town of East Haven after, it alleges, it was illegally shut down in May.

The quarry filed an initial $25 million lawsuit in May against East Haven Mayor Joseph Maturo, Jr., Zoning Enforcement Officer Christopher Soto, Town Assessor Michael Milici, and Fire Marshal Mark Nimons.

“The behavior of the mayor and these other three town officials was so egregious that it merited its own action, but the town must also bear responsibility for the illegal actions of its officials,” said Attorney Peter Alter, who represents Farm River Rock, in a statement emailed to the Courier.

Town Attorney Joseph Zullo also issued a statement, which included the following:

“The lawsuit received today, which names the town in its corporate capacity, is largely a recitation of the same claims alleged in a companion suit filed a few weeks ago. It is a development which our legal team fully anticipated and is prepared to address...I wish to assure our residents that our legal team will vigorously contest both actions and will do whatever is necessary to protect and defend our town officials, our residents, and the best interests of our community.”

Alter and John Patton, majority owner of the quarry, were present at a special Zoning Board of Appeals (ZBA) meeting on July 13, where they presented their case as to why the quarry was allegedly illegally shut down and why two cease and desist orders should be repealed, allowing to quarry to continue to operate.

Attorney John Conway and his client, Soto, will present their side at another special meeting of the ZBA scheduled for Thursday, Aug. 3.
