Judgment First, Trial Afterward


The Old Saybrook Water Pollution Control Authority (WPCA) is using a shameful ploy on un-lawyered Wastewater Management District property owners, sending them enforcement letters threatening to record their noncompliance with a Connecticut River Area Health District Upgrade Order in the town’s land records.

WPCA is threatening summary judgment without any process whatsoever.

In the absence of law supporting this recording, WPCA must think, to the extent that a multi-person agency can be said to think, that it can use “without objection,” a courtroom tactic, to illegally damage owners who don’t actively object to WPCA’s predation.
