Ordinance Isn’t Enforceable


On Feb. 16, 2012, the Connecticut River Area Health District (CRAHD), Old Saybrook Water Pollution Control Authority (WPCA)’s enforcement agent, sent us a Notice of Entry into Old Saybrook Wastewater Management District Program: Phased Implementation. Final Warning. It included the statement, “Should the application for entry into the Decentralized Wastewater Management Program not be received by the director of health within 30 days of the date of this letter, formal action will be taken as set forth in the ordinance.”

Old Saybrook’s wastewater ordinance isn’t enforceable. Were it enforceable, the town would have taken us (13 George Drive) to court years ago.

They haven’t. It isn’t.

The town, having no access to the courts for its illegal activity, resorts to bullying and shamelessly lying to its citizens and Department of Energy and Environmental Protection.
